For two years we've made the same argument in this space: the scarce asset in Texas isn't dirt, it's power. Interconnection, not acreage, is what decides value now. On June 10, Governor Abbott changed the rules of that game. He directed state regulators to make sure the cost of the data center boom doesn't land on residents' electric bills. A lot of people in our world read that as a headwind for the whole powered-land trade. We read it differently. For serious operators, the new guardrails are clarifying, and clarity is bullish.
Here's what actually happened. In a June 10 letter to Public Utility Commission Chairman Thomas Gleeson and ERCOT CEO Pablo Vegas, Governor Abbott directed the PUC and ERCOT to protect residential ratepayers from the costs of data center expansion. The core instruction was simple: data centers must fully fund the electric infrastructure needed to serve them, so those costs don't get passed on to families. Per the Governor's office, the PUC was told to begin reducing residential transmission costs by July 31, 2026, and the two agencies were asked to identify further protections. Abbott's framing left little ambiguity. Residential ratepayers, he said, will not foot the bill for this industry's growth.
In late July, Abbott released the agencies' response, and the steps are concrete. According to the Governor's office, data centers will be required to pay for the transmission infrastructure built to serve them and to contribute toward reducing residential electric bills. Regulators are adopting rules to keep large data centers from diverting existing grid power away from Texas homes and communities. ERCOT is implementing a new interconnection screening process to keep data centers from overburdening the grid, developing stronger standards projects must meet before they can connect, and mandating that new data centers cut their power quickly when ERCOT instructs. The agencies also recommended legislation for the next session: expanding the Lone Star Infrastructure Protection Act to cover large data centers, clarifying regulatory authority over reliability, and requiring data centers to register so the state has accurate power and water data.
Step back and the logic is straightforward, even if the details are still being written. The principle underneath all of it is cost-causer pays. If a data center needs new transmission and generation to run, the data center funds it. That is rational, and honestly it is what keeps the entire buildout politically durable. A boom that quietly raised every Texan's electric bill would generate a backlash that threatens the industry far more than sensible cost allocation ever could. Protecting the ratepayer protects the social license, and the social license is what lets the data center story keep running in Texas at all.

The interconnection screening and curtailment requirements do add friction. They also do something valuable that most of the headlines miss. They separate real, deliverable projects from speculative ones. ERCOT has warned for a while that requested large-load demand has surged to levels far beyond anything the grid has planned for, dominated by data centers, and a large share of any interconnection queue is phantom to begin with, developers filing on multiple sites to hedge their bets. A screening process thins that queue. When the marginal and speculative projects fall away, genuinely viable, well-structured, rule-compliant sites become more valuable, not less. Scarcity of the real thing goes up.
This is why we're not reading the directive as a threat to the powered-land thesis. It sharpens it. We've said the edge belongs to whoever understands power, and these rules push that edge even harder toward operators who understand the rulebook. Who pays for which piece of infrastructure. Which sites can actually clear the new screening. How a curtailment obligation changes a data center tenant's economics, and therefore what that tenant can pay for land. Those are underwriting questions, and they are local and technical, which is exactly where we would rather compete than in a bidding war over raw acreage.
We are not in the business of cheerleading policy or fighting it. We read it and we position. And the read here is clear enough. The firms that treated powered land as a simple land grab, buying speculative sites and hoping to flip into the queue, just got a much harder road. The firms that understood deliverability, infrastructure cost allocation, and grid rules just got a moat. We would rather own the moat.
It's worth saying plainly that this is a pro-Texas move, not a retreat from the boom. The state is trying to keep its single greatest advantage, a fast and business-friendly grid feeding a booming data center sector, while protecting the residents who make the state worth investing in. That is a market maturing, not a market cooling. A managed boom lasts longer than an unmanaged one.
The rulebook isn't finished. The July memo, the July 31 transmission action, and next session's legislation will fill in details, and we're watching every one of them, because each detail moves which sites win and which don't. But the direction is set. In Texas, data centers pay their own way, and the grid gets protected. For anyone who thought powered land was a simple story, it just got more complicated. Complicated is where local knowledge gets paid. The powered-land thesis isn't dead. It just got a rulebook, and we like our odds when there's a rulebook to master.
